Terms and Conditions

1. Only serious quote inquiries please. Prices are non-negotiable.
2. There is a minimum of 3 weeks' notice for all orders. Orders are not confirmed until your non-refundable deposit is received. Orders placed within two weeks of the pickup date require payment in full upon ordering, as this allows me to purchase ingredients and supplies. Any edits or changes to your order within a week of pickup may result in an additional fee as certain elements may have already been completed. If there is a request to increase the order, payment of the difference is due immediately or the request will not be honored.

Cake Designs

1. Exact copies of another bakery/product are not possible, I will not copy another artist’s work nor can I exactly recreate a cake from an image. We will work together to make your vision into a unique creation. 
2. I do not provide sketches or previews after your order is in progress, as it is time-consuming and delays the work process. Unfortunately, I do not sketch, which is the reason we will use inspirational pictures to base your cake on. I strive to bring you the best possible product(s) as discussed in your consultation. I will not copy another artists' work, but I will use it for inspiration to give you your own unique item(s). No design or flavor changes can be made after the remaining payment for your order has been received (one week before the pick-up date).
3. We will attempt to match the colors chosen but when dealing with food there may be a slight color variance. It will be our best effort to complete the color palette you have chosen. We are not responsible for color changes that may occur after the preparation of the food item which is part of the natural age progression of flavors and dyes. 
4. Under no circumstance will DISCO DUST, LUSTRE DUST, OR GLITTER be used on food items to be consumed unless it is labeled EDIBLE or FDA approved. These items are otherwise NONTOXIC but are not meant for human consumption. They may only be used on decorations to be removed before consumption. Sanding sugar, edible pearls, and ONLY hybrid or sparkle dust that are labeled EDIBLE can be used. This is NON-NEGOTIABLE. We take your health and safety very seriously.
5. If fresh flowers will be used on the cake from a florist (of your choosing), it is the responsibility of the florist to determine the safety of the flowers used. Not all fresh flowers are food products and should not be treated as such. Fresh flowers will not be provided iced by indira unless discussed during the consultation. By signing your Cake Contract, you waive the rights to compensation if illness or other occur from floral products. I will do my best to wrap and protect the flowers from direct contact with the cake itself.
6. I do not offer fondant-covered cakes. Depending on the theme, some cakes will have small fondant decorations.
7. I do not offer any pornographic or drug-themed cakes. 

Deposits

1. A deposit of 50% of your order total is due when your cake contract is signed by both parties for all NON-CUPCAKE orders. Cupcake-only orders are to be paid in full at the time of confirmation. All deposits and order payments must be sent via E-transfer. SORRY NO CHECKS.  Remaining order total payments are due in full one week before pick up for non-cupcake orders. There are no exceptions.
2. Once the deposit and signed Cake Contract are received, the order is confirmed. An order summary and invoice will be emailed to you.
3. Deposits are non-refundable. If it is your first time canceling your order with me, your deposit will be offered as credit for a future order- ONLY  if I am notified at least a week in advance. If you are up-front about any issues with your pickup date, I will work hard to accommodate you. I understand things can come up that are out of your control. In the event of postponement, please notify me as soon as possible to determine if a new pick-up date can be accommodated.

Cancellations and Refunds

1. Order cancellations within 72+ hours of pick up will receive a refund of your total, minus your deposit.
2. In the rare case that you are unhappy with your cake, you must call the day of your event, so that we can come to a satisfactory resolution.
3. Flavor and texture are subjective. Refunds or “future credit” requests based on the flavor or the texture will not be honored. Every order is sent through quality testing before completion to ensure we bring you a satisfactory product.
4. All first birthday orders will receive a free four-inch two-layer smash cake (vanilla frosting with choice of color, vanilla cake) with an additional cake order.
5. The free smash cakes are the ONLY cakes/treats from this bakery that are safe to smash as you wish. DO NOT smash any other cakes or other treats into anyone's face due to the stiffness of the buttercream and possible supports within the items. Iced by indira is NOT responsible for bodily damages caused by such acts.

Photography Release

1. Iced by Indira retains the rights to share photographs of orders for advertising purposes and networking purposes. *Photos will not be posted until AFTER the order has been picked up or delivered.* If the items ordered are a surprise, please let me know and I will delay posting until after the event time. If you do not wish to be tagged or have your name mentioned in the items, please notify me at the time of pick-up or delivery. 

Liability and “Acts of God”

1. In the event of the death of the customer/client, all monies will be refunded minus a percentage of the deposit within 5-10 business days. Percentage will be calculated on an individual basis. 
2. In the event of a "natural disaster", “Act of God”, or an emergency preventing an order pick-up, a credit of your total minus your deposit will be transferred to a future order occurring within 6 months of the order pick-up date.
3. Once a product is picked up the customer, iced by indira is no longer responsible for damages, care, or handling that may incur.

Allergens

1. Products may contain or come into contact with milk, eggs, wheat, nuts, soy, cocoa, or other allergens. Iced by indira is not responsible for any allergic reactions or medical conditions resulting from our products. It is the sole responsibility of the customer to make me aware of any allergies and to inform their guests if the issue arises. We will not be held responsible physically or financially for medical issues or emergencies including death.
2. If you or any of your guests follow vegetarian or vegan lifestyles, please be aware that for select icings, I use a brand of shortening that contains meat fat. We are not a vegan or gluten-free friendly bakery.
3. iced by indira Bakery produces its sweet treats in a kitchen not subject to inspection by the Department of State Health Services or a local health department, however, Iced by Indira Bakery ensures that your product is produced in a clean kitchen using thoroughly sanitized tools and equipment.
